FAYETTEVILLE, Tenn. (AP) — A Middle Tennessee judicial commissioner has been indicted on an assault charge.

The Tennessee Bureau of Investigation said a Lincoln County grand jury indicted 48-year-old Brian Thomas Rutledge on Tuesday on one count of assault stemming from an incident in February.

Rutledge, a judicial commissioner in Lincoln County, was released on his own recognizance.

Judicial commissioners issue criminal warrants, schedule court dates and set and approve bonds.

The TBI said the charge stems from an argument that took place Feb. 28 at a market in Fayetteville. The TBI said after the argument, one man started to drive away and was flagged down by Rutledge, who approached the man’s truck to speak to him and during the conversation grabbed the man by the neck.

Both men reported the incident to law enforcement officials
